Product liability cases involve injuries to victims
proximately caused by an unreasonably dangerous
product placed into the stream of commerce by
manufacturers, distributors or sellers.
These cases
are often referred to as strict liability in that,
unlike negligence, liability is based strictly on the
defective nature of the product rather than the degree
of care exercised by the wrongdoer.
One of Laird’s largest recoveries on behalf of a client was in a product liability case. He recovered $12 million for the defective design of a Black & Decker power saw. Product liability arises when an unreasonably dangerous product is placed into the stream of commerce by manufacturers, distributors or sellers and causes injuries. These cases can involve either negligence or strict liability of the defendant. Strict liability, unlike negligence, is based strictly on the defective nature of the product rather than the degree of care exercised by the wrongdoer. Laird has always gone the extra mile necessary to prosecute product liability cases, finding the most experienced experts to testify and garner the best outcome for victims.
